If the driver had insurance then the insurance will take care of the claims anyway (medical and their truck). They shouldn't need to even sue. I would think if they wanted to sue that video out there would be a bad idea. It’s the same in CA. They could file civilly. I’m surprised the guy wasn’t arrested but maybe he got a citation, for at least a misdemeanor (vs an infraction) for reckless driving, and will have to appear in criminal court. yes my sister was in medically induced coma for two months and had to learn to walk and talk again and has short term memory loss from her TBI for the rest of her life because she was a dumb teen who got in a car with a drunk driver.
